Legal & Data Due Diligence Audit

Data Licensing & Compliance Framework

Detailed legal due diligence regarding public transmission telemetry, exchange price benchmarks, and derived AI market analytics.

1. ENTSO-E Transparency Platform (CC-BY 4.0)

EnerxAI processes public grid telemetry published by the European Network of Transmission System Operators for Electricity (ENTSO-E) under European Union Regulation (EU) No 543/2013.

Licensing Terms: Creative Commons Attribution 4.0 International (CC-BY 4.0).
Permitted Uses: Commercial use, transformation, processing, and distribution of derived analytics are 100% permitted provided appropriate attribution is maintained.

Attribution Statement: Telemetry data sourced from ENTSO-E Transparency Platform. EnerxAI applies proprietary signal processing, stress scoring, and AI machine learning algorithms to generate derived market intelligence.

2. Power Exchange Spot Prices & Derived Analytics Compliance

EnerxAI strictly enforces data redistribution compliance regarding European power exchanges (including EPEX SPOT, Nord Pool, OMIE, GME, and TGE):

  • No Raw Order-Book Reselling: EnerxAI does not redistribute raw tick-by-tick exchange order books or proprietary depth-of-market feeds.
  • Derived Data Exemption: Day-Ahead clearing price benchmarks, zone stress indices (0–100), and 48-hour price direction forecasts qualify as Derived Information created through algorithmic computation and qualitative AI interpretation.
  • Exchange Compliance: Derived market metrics and AI commentary do not substitute for official exchange clearing feeds and comply fully with market data distribution guidelines.

3. Upstream Provider Protection & Circuit Breakers

To prevent rate-limit exhaustion or Denial of Service (DoS) impact on upstream data providers (similar to rate limits imposed by financial brokers like FYERS or ENTSO-E REST services):

  • Upstream In-Memory Caching: All upstream ENTSO-E requests are routed through a 60-second in-memory response cache. High-frequency user traffic hits the EnerxAI cache, ensuring upstream providers receive only 1 request per minute per zone.
  • Token Bucket API Rate Limiting: EnerxAI REST API endpoints enforce strict token bucket rate limits (10 request burst / 2 req/sec average per key) to protect system infrastructure.
  • Automated Circuit Breaker: In the event of an upstream provider outage or HTTP 429 response, EnerxAI automatically serves cached fallback telemetry without crashing downstream subscriber algorithms.

4. Financial Disclaimer & Trading Risk Notice

EnerxAI reports, signals, and price forecasts are provided for informational and decision-support purposes only. They do not constitute financial, investment, or commodities execution advice. Trading energy derivatives, day-ahead contracts, and carbon credits carries inherent market risk.
