These Terms of Service ("Terms") govern your access to and use of EnerxAI ("the Platform"), operated by Dev Vaibhav Markandey trading as EnerxAI ("we", "us", "our"). By creating an account or using the Platform, you agree to these Terms.
1. About EnerxAI
EnerxAI is a real-time grid intelligence platform providing data, analytics, and AI-generated intelligence reports for European power markets. The Platform is intended for use by energy market professionals including power traders, energy consultants, PPA brokers, and insurance underwriters.

READ THIS SECTION CAREFULLY BEFORE USING THE PLATFORM.
2.1 All content published by EnerxAI — including but not limited to zone intelligence reports, stress scores, Direction Signal™ indicators, spread analyses, country scorecards, 7-day scenario analyses, morning briefs, signal alerts, and the Transition Stress Index™ — constitutes market intelligence and data analysis only.
2.2 Nothing on the Platform constitutes, and nothing should be construed as:
- Financial advice
- Investment advice
- Trading advice or recommendations
- Regulated advice of any kind under the Financial Services and Markets Act 2000 or any equivalent legislation
2.3 EnerxAI is not authorised or regulated by the Financial Conduct Authority (FCA), the European Securities and Markets Authority (ESMA), or any other financial regulatory body.
2.4 All intelligence reports, signals, and analyses are produced using automated AI systems processing publicly available data. They are provided for informational and research purposes only.
2.5 You must not rely on any content on the Platform as the basis for making, or refraining from making, any trading decision, investment decision, or any other financial decision. Any such reliance is entirely at your own risk.
2.6 Past grid conditions, stress scores, and price patterns are not indicative of future prices or market outcomes. All forward-looking scenario analyses use IF/THEN framing and are not predictions.
2.7 EnerxAI accepts no liability whatsoever for any loss or damage — direct, indirect, consequential, or otherwise — arising from your reliance on any content published on the Platform.
3. Eligibility
3.1 You must be at least 18 years old to use the Platform.
3.2 The Platform is intended for professional use. By registering, you confirm that you are accessing the Platform in a professional capacity.
3.3 The Platform is not available to persons in jurisdictions where its use would be prohibited by applicable law.
4. Account Registration
4.1 You must provide accurate and complete information when creating an account.
4.2 You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4.3 You must notify us immediately at support@enerxai.io if you suspect any unauthorised use of your account.
4.4 We reserve the right to suspend or terminate accounts that violate these Terms.
5. Free Tier and Credits
5.1 New accounts receive 3 free intelligence report runs per report type (Zone Deep Dive, Day-Ahead Spread, Country Scorecard, and 7-Day Forecast) upon registration. No payment method is required to access free runs.
5.2 Free runs are non-transferable, have no cash value, and cannot be exchanged for any other benefit.
5.3 We reserve the right to modify the free tier allocation at any time with reasonable notice.
6. Wallet Credits and Payments
6.1 Wallet credits are purchased in advance and deducted when you generate paid intelligence reports.
6.2 Wallet credits are non-refundable except as required by applicable consumer protection law.
6.3 Credits do not expire.
6.4 Payments are processed by Dodo Payments, our third-party payment processor. By making a payment, you agree to Dodo Payments' terms of service.
6.5 All prices are in US Dollars (USD) unless otherwise stated. Applicable taxes may be added at checkout.
7. Subscriptions
7.1 Subscription products (Morning Brief and Signal Alerts) are billed monthly in advance.
7.2 A 14-day free trial is available for first-time subscribers to each product. Your payment method will be charged on day 15 unless you cancel before the trial ends.
7.3 Subscriptions automatically renew each month unless cancelled.
7.4 You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period. No partial refunds are provided for unused subscription periods.
7.5 We reserve the right to modify subscription pricing with 30 days' notice. Your continued subscription after the notice period constitutes acceptance of the new price.
8. Data Sources and Attribution
8.1 The Platform sources data from publicly available and licensed data providers including ENTSO-E, Energinet, GIE/AGSI, Elexon BMRS, Open-Meteo, and EIA. Data is provided "as is" from these sources.
8.2 We make reasonable efforts to ensure data accuracy but cannot guarantee the completeness, accuracy, or timeliness of any data displayed on the Platform.
8.3 Data quality flags are displayed where our systems detect potential data issues. You should exercise caution when data quality is flagged as suspect.
8.4 AI-generated intelligence reports are clearly marked as such. They are produced by automated systems and have not been reviewed or verified by a qualified human analyst.
9. Intellectual Property
9.1 The EnerxAI platform, its design, software, and original content (including the Transition Stress Index™ and Direction Signal™) are the intellectual property of Dev Vaibhav Markandey trading as EnerxAI.
9.2 Intelligence reports generated for you are licensed for your personal or internal business use only. You may not resell, redistribute, or publish report content without our prior written consent.
9.3 You may share individual data points or brief excerpts from reports with appropriate attribution ("Source: EnerxAI").
10. Acceptable Use
10.1 You agree not to:
- Use the Platform for any unlawful purpose
- Attempt to scrape, copy, or systematically extract data from the Platform
- Share your account credentials with third parties
- Attempt to circumvent any security or access controls
- Use the Platform to manipulate markets or in connection with any market abuse
11. Limitation of Liability
11.1 To the fullest extent permitted by applicable law, EnerxAI shall not be liable for any:
- Loss of profits or revenue
- Loss of data
- Trading losses
- Indirect or consequential loss
11.2 Our total aggregate liability to you for any claim arising under these Terms shall not exceed the amount you have paid to us in the 3 months preceding the claim.
11.3 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
12. Indemnity
You agree to indemnify and hold harmless EnerxAI and Dev Vaibhav Markandey from any claims, losses, or damages (including legal fees) arising from your use of the Platform or breach of these Terms.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Platform. Your continued use of the Platform after the effective date of any changes constitutes acceptance of the updated Terms.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
